1. Who we are

These Terms govern your use of thehumanproblem.ai and the marketing-automation, AI-receptionist, and related services provided by THP SOLUTIONS LLC ("THP," "we," "us").

2. Services

Specific engagements are described in the applicable order, proposal, or service agreement. Plans are month-to-month after any initial term unless otherwise agreed in writing.

3. Fees

Fees are as published on this site or set out in your agreement, billed in advance unless stated otherwise. Late or failed payments may result in suspension of services.

4. SMS / Text Messaging program terms

Program description. Our SMS program sends customer-care messages only: replies to your inquiry, appointment scheduling and reminders, and service updates related to work you've asked us about. We do not send marketing blasts to numbers that haven't opted in.

How you opt in. You opt in by submitting the contact form at thehumanproblem.ai/contact and checking the standalone, unchecked-by-default SMS consent boxes (customer-care / account updates, and separately marketing / promotional messages), which link directly to our Privacy Policy and these Terms at the point of consent; by texting our business number first; by verbally consenting during a call with us; or as an existing customer who has provided their number for active service.

Frequency, rates, and opting out. Message frequency varies based on your interaction with us. Message and data rates may apply. Reply STOP to opt out at any time and HELP for help. Consent is not a condition of purchase.

Carrier disclaimer. Carriers are not liable for delayed or undelivered messages. T-Mobile is not liable for delayed or undelivered messages.

5. Acceptable use

You may not use our services to send unlawful, deceptive, or unsolicited communications, or in violation of the TCPA, the Florida FTSA, CAN-SPAM, or carrier policies.

6. Intellectual property

We retain ownership of our tools, templates, and know-how. You retain ownership of your data, brand, and customer relationships, including your CRM data, phone numbers, and call recordings.

7. Disclaimers

Services are provided "as is." Modeled scenarios and calculators on this site are illustrations, not guarantees of results.

8. Limitation of liability

To the maximum extent permitted by law, THP's total liability arising out of the services is limited to the fees you paid to THP in the three months preceding the claim.

9. Governing law

These Terms are governed by the laws of the State of Florida. Venue lies in the state or federal courts located in Florida.
